TAX COLLECTION – VILLAGE OF GOODRICH
2005 VILLAGE TAX – The Village 2005 Tax statements will be mailed the first of July. If you receive your tax bill and it is paid by your bank or financial institution, please forward the bill to them for payment. Village taxes are payable without penalty and interest through September 30, 2005. On October 1, 2005, a penalty of 4% will be added, plus 1% interest per month starting on November 1, 2005. You may still pay the taxes until February 28, 2006, at the Village of Goodrich. After March 1, 2006, the unpaid taxes expected personal property, will be turned over to Genesee County Treasurer Office. The Village office is located at 7338 State Road, Goodrich, MI 48438.
The office hours are Monday 8:00 am – 6:00 pm Tuesday 8:00 am- 5:00 pm Wednesday 8:00 am – 4:00 pm Thursday 8:00 am – 5:00 pm Friday 8:00 am – 12:00 pm.
A Drop box is available in front of the Village Office to enable you to make payments after hours.
Taxpayers eligible to claim a deferment of summer property taxes may file an application for deferment until September 15, 2005. Tax deferred is not subject for penalty and interest until February 15, 2006. You may claim deferment of your homestead if your household income for the preceding calendar year did not exceed $25,000, and you qualify for one of the following classifications:
– 62 years of age or older, including the unmarried surviving spouse of a person who is 62 years of age or older at the time of death
– Paraplegic, Quadriplegic
– Eligible serviceperson, veteran, widow or widower
– Blind Person
– Totally and permanently disabled

The purpose of the hearing is to obtain citizen needs and project proposals concerning the use of federal CDBG funds for the 2006 program year. The hearing will also provide an opportunity for citizens to comment on past CDBG projects.

VILLAGE STREET SNOW REMOVAL POLICY
The Village of Goodrich has three levels of classifications for snow and ice removal.
Priority I streets will be plowed and salted first and could be done on any overtime bases. Streets classified as priority I, include: Hegel East, Hegel Road West, Erie, Seneca, Pontiac, Clarence and Cemetary.
Priority II streets will be maintained only after priority I streets are completed and they can also be done on overtime. Streets classified as priority II, include: Huron, Seneca south of Hegel, and Ridge Road.
Priority III streets are maintained only after priority II streets are completed and can be done on overtime, but this will be left to the discretion of the Administrator and/or the Department of Public Works Supervisor. Streets classified as priority III are sub-divisions, the Grove, Hawes, Putnam, Shuman, Hufsteader and Dutch.
The Department of Public Works will determine a schedule for snow plowing based on the priority classification and the amount of snow on the ground and/or amount of snow predicted. Overtime may be authorized when there is a minimum of three inches of snow on the ground. Salting/sanding will be done following the priority classification on an as needed bases as determined by the Administrator and/or Department of Public Works Supervisor.

Public notice
The Village of Goodrich would like to remind residents that parking on or along any public street, road or highway within the Village of Goodrich limits shall be prohibited by ordinance, between the hours of 2:00 am and 7:00 am daily, and during the effective period of a snow emergency.
The motor vehicle code prohibits the disposing of ice or snow in a road right of way by individuals or contracted snow removal companies.

Sec. 10.1 INTENT.
The Planned Unit Development District (PUD) is intended to allow flexibility of site design, a mixing of housing types, a mix of residential and non-residential uses, limited non-residential development where it may not otherwise occur under conventional zoning, in exchange for high quality site and building design, preservation of sensitive natural features and woodlands, and greater compatibility with the small town character of the Village.
Sec. 10.2 REQUIREMENTS REGARDING TRACT.
10.206 Recognizable Benefits. A PUD shall result in a recognizable and substantial benefit, both to the residents and occupants of the property and to the overall quality of life in the Village. The benefits can be provided through site design elements in excess of the requirements of this ordinance, such as high quality architectural design, extensive landscaping, provide transition areas from adjacent land uses, unique site design features, unified access, preservation of woodlands and open space, particularly along major thorofares, and buffering development from lakes, rivers, streams and wetlands. The proposed development shall provide at least one (1) of the following benefits:
a. Significant Natural Assets. The site contains significant natural assets such as woodlands, rolling topography with grades exceeding fifteen percent (15%), significant views, natural drainage ways, water bodies, floodplains, regulated or non-regulated wetlands, or natural corridors that connect quality wildlife habitats which would be in the best interest of the Village to preserve and which might be negatively impacted by conventional residential development.
b. Recreation Facilities. If the site lacks natural features, it can qualify if the development will preserve an existing recreation facility or provide new recreation facilities to which all residents of the development and the Village shall have reasonable access. Such recreation facilities include areas such as a neighborhood park, golf course, passive recreational facilities, soccer fields, ball fields, bike paths or similar facilities which provide a feature of community-wide significance.
c. Mixed Use. A site can qualify if the development will provide a complimentary and integrated mixture of uses, residential densities and housing types. A mixed use project shall be considered a project which proposes a combination of residential housing types or a mixture of compatible residential and commercial uses. Such mixture of uses shall be integrated into a cohesive, pedestrian scale neighborhood.
10.207 Guarantee of Open Space. The applicant shall guarantee to the satisfaction of the Planning Commission that all open space portions of the development will be maintained in the manner approved. Documents shall be presented that bind all successors and future owners in fee title to commitments made as a part of the proposal. This provision shall not prohibit a transfer of ownership or control, provided notice of such transfer is provided to the Village and the land uses and restrictions continue as approved in the PUD plan.
Sec. 10.3 PERMITTED USES.
10.301 Single family detached and attached dwellings.
10.302 Two family dwellings.
10.303 Multiple family dwellings.
10.304 Housing for the elderly (with maximum density calculated as noted in Article 8).
10.305 Public or private parks and outdoor recreation areas which may include a golf course, swimming pool, tennis court, ice skating rink and other similar recreational uses without outdoor lighting.
10.306 Family day care, family foster care, commercial day care.
10.307 Churches, places of worship.
10.308 Municipal buildings.
10.309 Essential public services.
10.310 Retail food establishments under 50,000 square feet which supply: groceries, fresh produce, meats, dairy products, baked goods, confections or similar commodities for consumption off the premises. Food stuffs may be prepared on the premises as an accessory use if sold at retail prices on premise.
10.311 Restaurants, delicatessens and other establishments serving food and/or beverages on premise, which may include seasonal outdoor seating, but without drive-through or drive-in service.
10.312 Banks, savings and loan, credit unions and other financial institutions with a maximum of three drive-through lanes. A drive-through ATM machine located anywhere on the site will count towards this maximum.
10.313 Stand alone automatic teller banking machines.
10.314 Retail businesses under 10,000 square feet conducted entirely within an enclosed building such as: drug stores, liquor, dry goods, clothing, video rental, furniture, hardware, music, book stores, antique stores and gift shops;
10.315 Personal service establishments such as but not limited to: small electronics repair shops, shoe repair, tailors, hair styling salons, spas, film processing outlets, copy centers, interior decorators, postal centers and dry cleaners.
10.316 Indoor commercial recreation, movie theaters, or fitness centers.
10.317 Professional offices such as medical, dental, chiropractors, osteopaths, insurance, real estate, attorney, financial and similar or allied professions.
10.318 Art galleries, art studios, photographer studios, dance studios, and theaters for stage productions or films.
10.319 Commercial schools.
10.320 Hospitals.
10.321 A building with a mixture of the above uses including a mixture of residential and non-residential uses.
10.320 Accessory uses, buildings, structures customarily incidental to any of the above Permitted Uses and meeting the Standards of Sections 3.0 through 3.3.
10.325 Similar uses as determined by the Planning Commission in accordance with the provisions of Section 3.60.
Sec. 10.5 DENSITY AND DESIGN STANDARDS.
10.501 The following density and use restrictions apply based upon the PUD type that is requested:
a. Residential PUD: A maximum of eighty (80) percent of the total site area shall be devoted to residential use: land devoted to residential use shall be deemed to include those streets, parking areas, private open spaces and courts which abut and service primarily residences or groups of residences, but it shall not include useable open space which is available for use by the general public or by persons who do not live in the residences or groups of residences immediately adjacent to it unless otherwise provided herein.
b. Mixed Use PUD: PUDs to incorporate residential and non-residential land uses, a maximum of twenty (20) percent of the total site area shall be used for non-residential development and required parking, circulation, and landscaping with the remaining portion of the site devoted to a maximum of sixty (60) percent residential use and a required minimum of twenty (20) percent open space.
c. Commercial PUD: PUDs with all non-residential land uses shall have a maximum of eighty (80) percent of the total site devoted for non-residential development and required parking, circulation, and landscaping with the remaining twenty (20) percent devoted to required open space.
10.502 Open Space: All land within a development that is not devoted to a use, roadway, or parking shall be set aside as common land for recreation or open space. A PUD shall provide a minimum of twenty percent (20%) of the gross site area as dedicated open space held in common ownership. Areas not considered open space are:
a. area proposed as single family residential lots;
b. area proposed to be occupied by buildings, including the minimum required setbacks around the building;
c. seventy-five percent (75%) of the land area devoted to detention or retention ponds;
d. the area of any street right-of-way;
e. any submerged land area of a pond, lake, river, or stream; and
f. any regulated wetland.
10.503 Regulatory Flexibility
a. To encourage flexibility and creativity consistent with the intent of the PUD regulations, the Planning Commission may permit specific departures from the requirements of the zoning ordinance as a part of the approval process.
b. Any regulatory modification shall be approved through a finding by the Planning Commission that the modification shall result in a higher quality of development than would be possible using conventional zoning standards and that there is a direct benefit to the Village as a result of the modification.
c. A table shall be provided on the site plan which specifically details all modifications. This specification should include ordinance provisions from which deviation are sought, and the reasons and mechanisms to be utilized for the protection of the public health, safety, and welfare in lieu of the regulations from which modifications are sought.
10.504 Residential PUD Dimensional Standards: Except as otherwise noted in table 4.6, Dimensional Standards – Residential Districts, there shall be no minimum lot size, no minimum setbacks and no minimum lot width for any unit. The density of the residential component shall be established by a parallel design plan. Such design plan shall demonstrate a project that is consistent with state, county, and village requirements and design criteria. The parallel plan shall meet all standards for lot size, lot width and setbacks are normally required by the Village. This plan will establish the number of allowable dwelling units for the PUD plan.
10.505 Commercial PUD Standards:
a. Dimensional Requirements: Projects shall comply with the dimensional setback requirement of the General Business District, unless otherwise modified as part of the PUD process.
b. Building Design and Layout: Buildings within a Commercial PUD shall be of the highest quality in terms of materials and design and shall be in accordance with the following guidelines:
1. The overall appearance will give the impression of a unified development.
2. The overall design will be consistent roof lines, varied building lines, distinguishing architectural features, cornice work, edge detailing, archways, high quality and varied materials.
3. Building facades will contain architectural features such as awnings, cornice work, edge detailing or other decorative features typical of building fronts.
4. At least 50% of the facade of buildings visible from public access will be finished in brick or other masonry material.
5. Buildings must use unifying elements, accents, style, color and materials.
6. The rear building facades of all buildings will not have the appearance of a backdoor fa’ade.
7. Window area shall make up at least 10% of the front facades.
8. Exterior colors shall be of low reflectance, subtle, neutral, or earth tone colors.
9. Each commercial building that fronts onto State Road shall have at least one (1) major public pedestrian entrance and pathway connection to the existing Village pathway system.
10. Building entrances shall be oriented towards State Road and located no further from the front lot line than the minimum front yard setback, to the extent feasible.
11. A maximum of 25% of the proposed parking spaces shall be located in the front yard.
c. Screening: In addition to other screening requirements in the Ordinance, a Commercial PUD shall provided the following screening:
1. Loading areas shall be located or designed on site to be minimally visible from adjacent roads and residential areas. Any loading service areas visible from a road or residential area will be screened.
2. Mechanical and service features such as gutters, ductwork, service doors, etc. that cannot be screened must be of a color that blends in with the color of the building.
3. Transformers, air conditioning and other mechanical equipment and utilities located on the ground or roof shall be screened.
d. Landscaping and Lighting: The Planning Commission or Village Council has the authority to impose additional landscaping or lighting requirements above and beyond those found in Section 3.25 and Section 3.28 if determined to be necessary to meet the intent and purpose of the PUD.
10.506 Location of Structures: The proposed location and arrangement of structures shall not be detrimental to existing or prospective development of the neighborhood. Every single family and two family dwelling unit shall have access to a public street, court, walkway or other area dedicated to public use. No structure and no group of structures (such as semidetached dwellings or a row of townhouses) shall be erected within twenty-four (24) feet of any other structure or group of structures.
10.507 Protection of open spaces: Open spaces between structures, including those spaces being used as public or private recreational areas, shall be protected by adequate covenants running with the land or by conveyances or dedications, as specified by the Planning Commission.
10.508 Open Space Setback. The Planning Commission may require a minimum fifty (50) foot wide undisturbed open space setback from the edge of any lake, pond, river, stream or wetland; provided that the Planning Commission may permit trails, boardwalks, observation platforms or other similar structures that enhance passive enjoyment of the site’s natural amenities within the setback.
10.509 Streets: All streets within the PUD development shall be built to the standards of the Village of Goodrich Street and Driveway Design Ordinance, and dedicated to the Village.
10.510 Unified Design Elements: All projects shall be designed to incorporate unifying design elements consistent with the Village of Goodrich design theme such as the light poles, benches, and trash receptacles.
Sec. 10.6 PROCEDURE.
10.601 PUD Rezoning Submittal Requirements:
a. The applicant shall submit an application form and fee, legal description and proof of property ownership to the Village for rezoning to PUD.
b. The applicant shall provide fifteen (15) copies an overall PUD plan at an engineering scale with the rezoning request. The PUD rezoning plan shall include an illustration of the sites existing natural features, including wetlands, lakes, ponds, streams, woodlands, all trees with a caliper of over eight (8) inches, topography at two foot contour intervals, and an indication of drainage patterns.
c. A conceptual PUD plan illustrating the location and acreage to be devoted to specific uses, open space areas, alignment of streets and drives and general location of parking areas, the location of buildings, the proposed density of dwelling units, a list of proposed uses, and a general layout of utilities.
d. As deemed necessary by the Village, a written impact assessment which describes the impact of the PUD project on the natural features, school enrollment, traffic generation and expected changes to operations on adjacent public streets determined by a registered traffic engineer, changes to drainage patterns, affects of wildlife, capability of public utilities to serve the development, and the relationship to surrounding land uses. The applicant should attach correspondence from appropriate agencies in support of the findings.
10.602 PUD Rezoning Procedure.
a. The Planning Commission shall use the criteria of Section 15.4 in reviewing the PUD rezoning request. Those criteria shall include the desirability of the planned unit development’s design in terms of traffic safety, health, drainage, densities, land use relationships of proposed uses to each other and uses adjacent to the site and its overall relation to a community development plan if such exists.
b. The Planning Commission shall recommend to the Village Council to either approve or deny the PUD rezoning request. The Planning Commission may also suggest changes to the PUD plan which the applicant may incorporate prior to submitting for Council action.
c. The Village Council shall approve, approve with conditions, or deny the PUD rezoning request.
10.603 PUD Site Plan Submittal Requirements and Procedure.
a. Within six (6) months of PUD zoning approval, the applicant shall submit a detailed site plan according to the procedures outlined in Article 16, Site Plan Approval.
b. The Planning Commission shall review the detailed PUD site plan according to the procedures and review standards outlined in Article 16 and a finding the final site plan is consistent with the overall plan originally submitted by the developer.
c. Approval of any detailed PUD site plan shall lapse unless construction is started within one (1) year.
10.604 Changes to a PUD Plan.
a. Any change to the PUD plan shall be submitted to the Planning Commission. The change should be described both on a site plan and in writing. The Planning Commission may approve a minor change, however, if the Planning Commission determines the change as significant, the applicant shall resubmit for PUD rezoning as outlined in Section 10.501 above.

Article 19 Administration and Enforcement
Sec 19.5 Conditional Zoning Agreement:
Pursuant to Act No. 579 of the Public Acts of 2004, amending the City and Village Zoning Act, 1921 PA 207, an applicant for a rezoning may voluntarily offer a conditional zoning agreement (herein referred to as ‘zoning agreement?) along with an application for rezoning before or following the public hearing for a proposed rezoning. The following requirements shall apply:
A. Content of Agreement: The zoning agreement shall include the following:
1. A description of the conditions, in accordance with Section 19.5(B).
2. Acknowledgement that the zoning agreement was proposed voluntarily by the applicant.
3. Agreement and understanding that the property shall not be developed or used in any manner that is not consistent with the zoning agreement.
4. Agreement and understanding that the approval of the rezoning and the zoning agreement shall be binding upon and inure to the benefit of the property owner and the Village, and also their respective heirs, successors, assigns, receivers or transferees.
5. Agreement and understanding that, if a rezoning with a zoning agreement becomes void in accordance with this section, that no further development shall take place and no permits shall be issued unless and until a new zoning district classification for the property has been established.
6. Agreement and understanding that no part of the zoning agreement shall permit any activity, use, or condition that would otherwise violate any requirement or standard that is otherwise applicable in the new zoning district.
7. Any other provisions as are agreed upon by the applicant, property owner, and the Village.
B. Allowable Conditions: The zoning agreement shall only include conditions that bear a reasonable and rational relationship and/or benefit to the property in question. The zoning agreement may include one or a combination of the following conditions:
1. Techniques to minimize the impact of the development on surrounding properties.

2. Methods to preserve natural features and open space.
3. Limitations on the uses permitted on the property in question.
4. Specification of lower density or less intensity of development and use.
5. More restrictive measures on the location, size, height, or other measure for buildings, structures, improvements, setbacks, landscaping, buffers, design, architecture and other features.
6. Commitment to extension, installation or construction of or improvements to roadways, utilities or other infrastructure serving the site.
C. Prohibited Provisions: The zoning agreement may not authorize the following:
1. Uses or developments of greater intensity or density.
2. Uses which are not permitted in the proposed zoning district.
3. Variations from height, area, setback or similar dimensional requirements which are less restrictive than the proposed zoning district.
4. Any conditions that do not have a reasonable and rational relationship to the subject site.
D. Review and Approval Process: In addition to the standard amendment procedures set forth in Section 19.3, when a Zoning Agreement is incorporated, the following additional steps are required. 1.
The proposed zoning agreement may be submitted prior to or following the Planning Commission public hearing.
2. If the proposed agreement is provided following the public hearing it must be reviewed by Planning Commission prior to Planning Commission making its recommendation on the rezoning to the Village Council.
3. If submitted prior to or at the same time as the rezoning application, both shall be reviewed and action taken currently.
4. The proposed zoning agreement shall be reviewed by the Village Attorney to determine that the zoning agreement conforms to the requirements of this Section and the City and Village Zoning Act, as amended, and shall confirm that the zoning agreement is in a form acceptable for recording with the Genesee County Register of Deeds.
5. Upon approval of the zoning agreement and rezoning, the approved zoning agreement shall be executed by the applicant, the property owner, and the Village and recorded with the Genesee County Register of Deeds.
6. The approved zoning agreement and rezoning shall be referenced on the Zoning Map with the new district, plus a number chronologically assigned to indicate that the property is subject to a zoning agreement (i.e., ‘LDR-1,? ‘GBD-2?). The Village Administrator shall maintain a listing of all properties subject to zoning agreements and shall provide copies of the Agreements upon request.
E. Standards of Review: The Planning Commission and Village Council shall use the Criteria listed in Section 19.4 to evaluate the rezoning. In addition, the Planning Commission and Village Council shall consider whether the proposed zoning agreement meets the following additional criteria:
1. Is consistent with the intent of this Article.
2. Bears a reasonable and rational connection and/or benefit to the property being proposed for rezoning.
3. Is necessary to insure that the property develops in such a way that protects the surrounding neighborhood and minimizes any potential impacts to adjacent properties.
4. Is necessary to allow the rezoning to be approved, in that the property could not or would not be rezoned without the proposed zoning agreement.
5. Leads to a better development that is more compatible with abutting or surrounding uses than would have been likely if the property were left to develop under teh existing zoning classification.
6. Is consistent with the Master Plan.
F. Expiration:
1. Two-Year Expiration: The rezoning and zoning agreement shall expire two (2) years after adoption of the rezoning and zoning agreement, unless substantial construction on the approved development of the property pursuant to building and other required permits issued by the Village commences within the two (2) year period and proceeds diligently to completion, as required by ordinance unless extended by the Village for good cause shown by the applicant.
2. Agreement Void: In the event that substantial construction on the approved development has not commenced within the aforementioned two (2) years, the zoning agreement shall be void and of no effect.
3. Development Cease: Should the zoning agreement become void, all development on the subject property pursuant to the agreement shall cease, and no further development consents, or approvals shall be permitted. Until action satisfactory to the Village is taken to bring the property into compliance with the zoning agreement, the Village may withhold or, following notice to the applicant and being given an opportunity to be heard, revoke permits and certificates, in addition to or in lieu of any other lawful action to achieve compliance.
4. First Extension: Notwithstanding the above, if the property owner applies in writing for an extension of the zoning agreement at least thirty (30) days prior to the expiration date and submits satisfactory evidence with just cause for the extensions, the Village Council may, after recommendation by the Planning Commission, grant an extension of up to one (1) year.
5. Second Extension: A second extension of one (1) year may be granted provided the applicant’s progress in developing the property is in accordance with the provisions of the zoning agreement and that there has been progress since the first extension granted.
G. Failure to Comply: Failure to comply with the zoning agreement at any time after approval will constitute a breach of the agreement and also a violation of this Ordinance, and further use of the property may be subject to legal remedies available to the Village.
H. Reversion of Zoning: If the rezoning and zoning agreement become void as outlined above, then the land shall automatically revert back to its original zoning classification as set forth in MCL 125.286i. The Village Clerk will advise the land owner and developer, by registered letter, of the reversion of zoning.
I. Subsequent Rezoning of Land: Nothing in the zoning agreement, nor any statement or other provision, shall prohibit the Village from later rezoning all or any portion of the property that is the subject of the zoning agreement to another zoning classification. Any rezoning shall be conducted in compliance with this Ordinance and the City Zoning Act. Any land use initiated pursuant to the zoning agreement shall be allowed to continue, after any later rezoning under this Subsection, in accordance with Subsection J below.
J. Continuation:
1. Provided that all development and/or use of the property in question is in compliance with the zoning agreement, a use or development authorized thereunder may continue indefinitely, provided that all terms of the zoning agreement are followed.
2. Failure to comply with the zoning agreement at any time after approval will constitute a breach of the agreement and also a violation of this Ordinance, and further use of the property may be subject to legal remedies available to the Village under the Zoning Ordinance and the Village Zoning Act.
K. Amendment:
1. During the initial two (2) year period, or during any extension granted by the Village as permitted above, the Village shall not add to or alter the zoning agreement, even with the landowner’s consent.
2. The Zoning Agreement may be amended after the expiration of the initial two (2) year period and any extensions, in the same manner as was prescribed for the original rezoning and Zoning Agreement.
L. Other Required Reviews: Any uses proposed as part of a zoning agreement that would otherwise require approval of a special land use or site plan approval shall be subject to the applicable review and approval requirements of Articles 30 and 33.
M. Failure to Offer Conditions. The Village shall not require an owner to offer conditions as a requirement for rezoning. The lack of an offer of conditions shall not affect the owner’s rights under this Ordinance.
N. Performance Guarantee. If the Developer proposes to construct any public improvements in connection with the development of the Project, the Village shall be provided with an irrevocable letter of credit in an amount equal to the expected cost of the public improvements. The Developer shall also warrant the public improvements for a period of one year from the date of acceptance of same by the Village and shall, at its sole expense, repair or replace, at the Village’s sole discretion, any public improvements which fail during the one-year period following its acceptance by the Village. The value of the letter of credit may be reduced as the Village accepts the public improvements, by the value of the work accepted, but 25% of the letter of credit shall remain in effect for the duration of the one-year warranty period.

NOTICE IS HEREBY GIVEN:
1. The Village Council of the Village of Goodrich, Genesee County, Michigan has determined it necessary to make improvements in the Village of Goodrich. Those improvements shall consist of (1) weekly residential solid waste collection, (2) bi-weekly residential recycling collections, (3) weekly residential yard waste collection from April 1 through November 30. The Village Council has determined to defray the cost of such improvements by assessing the property which will be especially benefited thereby, and a special assessment roll indicating the amount each parcel of such property will be assessed has been prepared in connection therewith. NAME AND DESCRIPTION OF SPECIAL ASSESSMENT DISTRICT
SOLID WASTE, RECYCLING AND YARD WASTE COLLECTION SPECIAL ASSESSMENT DISTRICT.
All improved (sewer or building permit issued) residential properties located within the boundaries of the Village of Goodrich, as shown on the current tax rolls of the Village of Goodrich on May 30, 2006, 2007, 2008.
2. The method of determining the benefits upon the property is predicated upon a per
parcel bases.
3. The special assessment roll, the plans, the specifications, the maps showing the location of the improvements and the Solid Waste, Recycling And Yard Waste Collection Special Assessment District (the ‘District?) and the cost estimates for the improvements are on file at the office of the Village Clerk, 7338 S State Road, Goodrich, Michigan 48438, 810.636.2570 for public examination.
4. The special assessments on said special assessment roll for the District against each parcel of land thereon shall be due on July 1, 2006 and July 1 each year of the assessment.
5. The Village Council will meet in the Lyceum Building, Second Floor, Community Room, 10237 Hegel Road, Goodrich, Michigan, at 7:00 PM, Eastern Daylight Time, on Monday, June 12, 2006, in order to hold a public hearing for the purpose of correcting and reviewing the special assessment roll. At such hearing, the Council shall review said roll and hear and consider any objections or suggestions which may be submitted by any interested person with respect to: (1) the roll; (2) the proposed improvement; (3) the assessing of the District therefor; (4) the portion of the cost of the improvements to be paid by special assessment; (5) the method of determining the benefits upon the property in the District.
6. The Village Council may then, or at a later date confirm the roll as reported or corrected. However, the original special assessment roll shall not be confirmed except by the affirmative vote of four members of the Council, if prior to such confirmation, written objections to the proposed improvements have been filed by the owners of the property which will be required to bear more than 50 percent of amount of the special assessment.
7. If the Village Council approves the establishment of the special assessment district and the making of the improvements, a special assessment will be levied against properties that benefit from the improvements. The Tax Tribunal Act, Act No. 186, Public Acts of Michigan, 1973 as amended, provides that an appearance and protest of the special assessment must be made at the hearing described above in order to appeal the amount of the special assessment to the Michigan Tax Tribunal. An owner of or party in interest in property to be assessed, or his or her agent, may appear in person to protest the special assessment, by letter filed with the Village clerk at or prior to the time of the hearing, in which case appearance in person is not required.

AMENDMENT TO VILLAGE OF GOODRICH CODE OF ORDINANCES
Please take notice that the Goodrich Village Council, at their regular meeting held on the 13th day of February, 2012, adopted an amendment to Chapter 2, Administration, of the Code of Ordinances. Specifically, Chapter 2, ‘Administration,? of the Village of Goodrich Code of Ordinances, Article IV, ‘Boards and Commissions,? Division 2, ‘Planning Commission? has been revised in order to conform to the Michigan Planning Enabling Act, M.C.L. 125.3801 et. Seq. (P.A. 33 of 2008), as amended. The amendment provides, in summary, for the following as it relates to the Planning Commission in the Village of Goodrich:
Sec. 2-111 Scope, Purpose and Intent
This section confirms the establishment of the Goodrich Planning Commission to establish the appointments, terms, and membership of the commission; to identify the officers and the minimum number of meetings per year of the planning commission; and to prescribe the authority, powers and duties of the Planning Commission.

This section re-establishes the Planning Commission in Goodrich according to the new statute.

This section affirms the Planning Commission’s duty to review and make recommendations pursuant to the Subdivision and Land Division ordinances in the Village of Goodrich.
Sec. 2-123 Personnel; Contract for Services
This section provides for hiring of planning consultants and staff to assist in carrying out the duties above.
Sec. 2-124 Gifts
This section provides for the receipt and deposit of gifts.

ORDINANCE 144
AN ORDINANCE TO AMEND GOODRICH CODE OF ORDINANCES, 36 ZONING, SECTION 36-522 ACCESSRY BUILDINGS, STRUCTURES AND USES, TO ALLOW OUTDOOR WOOD BURNING STOVES
Sec. 36-555. Outdoor Furnaces.
(1) The stove/furnace unit shall be only for the purpose of heating and/or hot water for a dwelling and/or accessory structure(s) on the same lot.
(2) The applicant for a permit for an outdoor wood furnace shall submit a site plan showing that the installation of the unit meets the following requirements:
(a)???’The stove/furnace unit shall be a minimum of?30 feet from any other however, a structure built and used strictly for sheltering wood or other approved fuel for the unit may be located no less than eight feet from the unit.
(b)???’The stove/furnace unit shall be located a’minimum of 100 feet’from any property line.
(c)???’The unit shall not be located in the front yard.
(d)???’Other than woodpiles and other approved combustibles used for fuel, an area at least 30 feet in diameter around the unit shall be free of ignitable vegetation and debris.
(e)???’The chimney shall be insulated and a minimum of?10 feet high? to a maximum of 35 feet. Chimney guy wires, if necessary, shall be clearly visible at all heights below nine feet. If there are any other residences not served by the outdoor furnace within 250 feet, the insulated chimney shall also extend at least two (2) feet higher above the ground surface as the height of the roofs of all such residences. If such height exceeds manufacturer’s specifications, then the outdoor furnace shall not be permitted. Chimneys shall have a spark arrestor installed on top and be constantly maintained in good repair without rust or other blighted areas.
(3) Emissions standards
(a)???’All outdoor wood furnaces installed after the effective date of this Ordinance shall comply, at minimum, with the Phase 2 emissions guidelines of the United States Environmental Protection Agency’s (USEPA) Voluntary Program for Hydronic Heaters. Should the USEPA, the State of Michigan or Genesee County adopt more restrictive emissions requirements, all wood boilers installed after the effective date of the new requirements shall comply with the more restrictive requirements.??
(b)???’Any outdoor wood furnace installed prior to the adoption of this ordinance that does not meet this subsection C shall be considered to be conforming, provided that all other requirements of this Section are met.??
(4) A copy of the manufacturer’s installation and operation instructions shall be submitted as part of the permit application. The applicant shall provide a written statement from the installer that the outdoor wood boiler was installed according to all manufacturer’s instructions and any applicable Village, county, state or federal requirements.
(5) Burning Materials, Wood Storage, and Waste
(a) Only seasoned, dry and untreated wood and clean burning wood byproducts (such as wood pellets) may be used for fuel. Other biomass fuel materials may be used (such as corn cobs) provided that the unit is designed to burn such materials while meeting the emissions requirements stated in this Section.?’Trash, garbage, plastics, gasoline, rubber, naphtha, material treated with petroleum products (particle board, railroad ties and pressure treated wood), leaves, paper products, cardboard and material that could pose a hazard to surrounding residents shall not be used for fuel.
(b) No more than one cord of firewood shall be kept or stored outdoors at any time, and firewood shall only be kept or stored in a straight and orderly, neat and secure stack, which shall be raised a minimum of 6 inches from grade and is not stacked more than 6 feet high.
(c) Firewood shall not be kept or stored in the front yard.
(d) All brush, debris and refuse from processing of firewood shall be promptly removed from the premises.
(6) The outdoor wood furnace shall be operated according to the manufacturer’s instructions as well as all applicable Village, county, state or federal requirements.
Sec. 36-8. Definitions.
Chimney.? A vertical structure enclosing a flue or flues that carry off smoke or exhaust from an outdoor furnace, including that part of the structure extending above a roof.
Firewood. Trunks and branches of trees and bushes, but does not include leaves, needles, vines or brush smaller than three inches in diameter.
Outdoor Wood Burning Furnace.? Any equipment, device or apparatus, or any part thereof, which is installed, affixed or situated outdoors for the primary purpose of combustion of fuel to produce heat or energy used as a component of a heating system providing heat for any interior space.
Untreated Lumber.? Dry wood that has been milled and dried but which has not been treated or combined with any petroleum product, chemical, preservative, glue, adhesive, stain, paint or other substance.

the village of goodrich would like to remind residents that parking on or along any public street, road or highway within the village of goodrich limits shall be prohibited by ordinance, between the hours of 2:00 AM and 7:00 AM daily, and during the effective period of a snow emergency.
The motor vehicle code prohibits the disposing of ice or snow in a road right of way by individuals or contracted snow removal companies.

TO OWNERS OF LAND SITUATED IN THE VILLAGE OF GOODRICH, GENESEE COUNTY, STATE OF MICHIGAN:
NOTICE is hereby given that all noxious weeds and/or grass found growing to a height greater than eight (8″) inches in height may be cut by the Village and the owner of the property according to the Village tax rolls will be charged with the costs including the actual cost of doing the work and an administration fee as determined by Resolution of the Goodrich Village council.
The Village will cut the weeds with a lawnmower or other appropriate device.
This Notice authorizes the Village to cut the weeds between May 1st and October 1st, 2015, as many times as is necessary and to charge all costs to the property owner.
The property owner of any land or premises will be determined by a search of the tax records in the Village.

ORDINANCE ADDRESSING FLOODPLAIN MANAGEMENT PROVISIONS OF THE STATE CONSTRUCTION CODE
Community Name: Village of Goodrich, County: Genesee
Ordinance number 143.
An ordinance amendment to designate an enforcing agency to discharge the responsibility of the Village of Goodrich located in Genesee County, and to designate regulated flood hazard areas under the provisions of the State Construction Code Act, Act No. 230 of the Public Acts of 1972, as amended.
The Village of Goodrich ordains: Section 1. AGENCY DESIGNATED. Pursuant to the provisions of the state construction code, in accordance with Section 8b(6) of Act 230, of the Public Acts of 1972, as amended, the Building Official of the Village of Goodrich is hereby designated as the enforcing agency to discharge the responsibility of the Village of Goodrich under Act 230, of the Public Acts of 1972, as amended, State of Michigan. The Village of Goodrich assumes responsibility for the administration and enforcement of said Act through out the corporate limits of the community adopting this ordinance. Section 2. CODE APPENDIX ENFORCED. Pursuant to the provisions of the state construction code, in accordance with Section 8b(6) of Act 230, of the Public Acts of 1972, as amended, Appendix G of the Michigan Building Code shall be enforced by the enforcing agency within the Village of Goodrich.
Section 3. DESIGNATION OF REGULATED FLOOD PRONE HAZARD AREAS. The Federal Emergency Management Agency (FEMA) Flood Insurance Study (FIS) Entitled Genesee County, Michigan(All Jurisdictions) and dated 9/25/2009 and the Flood Insurance Rate Map(s) (FIRMS) panel number(s) of 26049C; 0342D, 0344D, and 0365D and dated 9/25/2009 are adopted by reference for the purposes of administration of the Michigan Construction Code, and declared to be a part of Section 1612.3 of the Michigan Building Code, and to provide the content of the ‘Flood Hazards? section of Table R301.2(1) of the Michigan Residential Code.
Section 4. REPEALS. All ordinances inconsistent with the provisions of this ordinance are hereby repealed.
Section 5. PUBLICATION. This ordinance shall be effective after legal publication and in accordance with the provisions of the Act governing same.

ORDINANCE NO. 146 CONSUMERS ENERGY COMPANY ELECTRIC FRANCHISE ORDINANCE
AN ORDINANCE, granting to CONSUMERS ENERGY COMPANY, its successors and assigns, the right, power and authority to construct, maintain and commercially use electric lines consisting of towers, masts, poles, crossarms, guys, braces, feeders, transmission and distribution wires, transformers and other electrical appliances on, under, along and across the highways, streets, alleys, bridges, waterways, and other public places, and to do a local electric business in the VILLAGE OF GOODRICH, GENESEE COUNTY, MICHIGAN, for a period of thirty years.
THE VILLAGE OF GOODRICH ORDAINS:
SECTION 1. GRANT, TERM. The VILLAGE OF GOODRICH, GENESEE COUNTY, MICHIGAN, hereby grants the right, power and authority to the Consumers Energy Company, a Michigan corporation, its successors and assigns, hereinafter called the ‘Grantee,? to construct, maintain and commercially use electric lines consisting of towers, masts, poles, crossarms, guys, braces, feeders, transmission and distribution wires, transformers and other electrical appliances for the purpose of transmitting, transforming and distributing electricity on, under, along and across the highways, streets, alleys, bridges, waterways, and other public places, and to do a local electric business in the VILLAGE OF GOODRICH, GENESEE COUNTY, MICHIGAN, for a period of thirty years.
SECTION 2. CONSIDERATION. In consideration of the rights, power and authority hereby granted, said Grantee shall faithfully perform all things required by the terms hereof.
SECTION 3. CONDITIONS. No highway, street, alley, bridge, waterway or other public place used by said Grantee shall be obstructed longer than necessary during the work of construction or repair, and shall be restored to the same order and condition as when said work was commenced. All of Grantee’s structures and equipment shall be so placed on either side of the highways as not to unnecessarily interfere with the use thereof for highway purposes. All of Grantee’s wires carrying electricity shall be securely fastened so as not to endanger or injure persons or property in said highways. The Grantee shall have the right to trim trees if necessary in the conducting of such business, subject, however, to the supervision of the highway authorities.

SECTION 4. HOLD HARMLESS. Said Grantee shall at all times keep and save the Village free and harmless from all loss, costs and expense to which it may be subject by reason of the negligent construction and maintenance of the structures and equipment hereby authorized. In case any action is commenced against the Village on account of the permission herein given, said Grantee shall, upon notice, defend the Village and save it free and harmless from all loss, cost and damage arising out of such negligent construction and maintenance.
SECTION 5. EXTENSIONS. Said Grantee shall construct and extend its electric distribution system within said Village, and shall furnish electric service to applicants residing therein in accordance with applicable laws, rules and regulations.
SECTION 6. FRANCHISE NOT EXCLUSIVE. The rights, power and authority herein granted, are not exclusive.
SECTION 7. RATES. Said Grantee shall be entitled to charge the inhabitants of said Village for electricity furnished therein, the rates as approved by the Michigan Public Service Commission, to which Commission or its successors authority and jurisdiction to fix and regulate electric rates and rules regulating such service in said Village, are hereby granted for the term of this franchise. Such rates and rules shall be subject to review and change at any time upon petition therefor being made by either said Village, acting by its Village Council, or by said Grantee.
SECTION 8. REVOCATION. The franchise granted by this ordinance is subject to revocation upon sixty (60) days written notice by the party desiring such revocation.
SECTION 9. MICHIGAN PUBLIC SERVICE COMMISSION, JURISDICTION. Said Grantee shall, as to all other conditions and elements of service not herein fixed, be and remain subject to the reasonable rules and regulations of the Michigan Public Service Commission or its successors, applicable to electric service in said Village.
SECTION 10. REPEALER. This ordinance, when accepted and published as herein provided, shall repeal and supersede the provisions of an electric ordinance adopted by the Village on February 13, 1984 entitled:
AN ORDINANCE, granting to CONSUMERS POWER COMPANY, its successors and assigns, the right, power and authority to construct, maintain and commercially use electric lines consisting of towers, masts, poles, cross arms, guys, braces, feeders, transmission and distribution wires, transformers and other electrical appliances on, under, along and across the highways, streets, alleys, bridges and other public places, and to do a local electric business in the VILLAGE OF GOODRICH, GENESEE COUNTY, MICHIGAN.
and amendments, if any, to such ordinance whereby an electric franchise was granted to Consumers Energy Company.
SECTION 11. EFFECTIVE DATE. This ordinance shall take effect upon the later of ten days following adoption or upon publication thereof; provided, however, it shall cease and be of no effect after thirty days from its adoption unless within said period the Grantee shall accept the same in writing filed with the Village Clerk. Upon acceptance and publication hereof, this ordinance shall constitute a contract between said Village and said Grantee.
We certify that the foregoing Franchise Ordinance was duly enacted by the Village Council of the VILLAGE OF GOODRICH, GENESEE COUNTY, MICHIGAN, on the 8th day of December, 2014.

NOTICE OF PUBLIC HEARING REGARDING THE SOLID WASTE,
RECYCLING AND YARD WASTE COLLECTION IMPROVEMENT
SPECIAL ASSESSMENT DISTRICT AND THE SPECIAL ASSESSMENT ROLL THEREFORE
NOTICE IS HEREBY GIVEN:
1. The Village Council of the Village of Goodrich, Genesee County, Michigan has determined it necessary to make improvements in the Village of Goodrich. Those improvements shall consist of (1) weekly residential solid waste collection, (2) bi-weekly residential recycling collections, (3) weekly residential yard waste collection from April 1 through November 30. The Village Council has determined to defray the cost of such improvements by assessing the property which will be especially benefited thereby, and a special assessment roll indicating the amount each parcel of such property will be assessed has been prepared in connection therewith. The estimated cost, the amount to be specially assessed to each property and the special assessment district for the next four (4) years are as follows:

NAME AND DESCRIPTION OF SPECIAL ASSESSMENT DISTRICT
SOLID WASTE, RECYCLING AND YARD WASTE COLLECTION SPECIAL ASSESSMENT DISTRICT.
All improved (sewer or building permit issued) residential properties located within the boundaries of the Village of Goodrich, as shown on the current tax rolls of the Village of Goodrich on May 30, 2009, 2010, 2011, 2012. The method of determining the benefits upon the property is predicated upon a per parcel basis.
3. The special assessment roll, the plans, the specifications, the maps showing the location of the improvements and the Solid Waste, Recycling And Yard Waste Collection Special Assessment District (the ‘District?) and the cost estimates for the improvements are on file at the office of the Village Clerk, 7338 S State Road, Goodrich, Michigan 48438, 810.636.2570 for public examination.
4. The special assessments on said special assessment roll for the District against each parcel of land thereon shall be due on July 1, 2009 and July 1 each year of the assessment.
5. The Village Council will meet in the Village Office, Lower Level, Community Room, 7338 S State Road, Goodrich, Michigan, at 7:00 PM, Eastern Daylight Time, on Monday, June 8, 2009, in order to hold a public hearing for the purpose of correcting and reviewing the special assessment roll. At such hearing, the Council shall review said roll and hear and consider any objections or suggestions which may be submitted by any interested person with respect to: (1) the roll; (2) the proposed improvement; (3) the assessing of the District therefor; (4) the portion of the cost of the improvements to be paid by special assessment; (5) the method of determining the benefits upon the property in the District.
6. The Village Council may then, or at a later date confirm the roll as reported or corrected. However, the original special assessment roll shall not be confirmed except by the affirmative vote of four members of the Council, if prior to such confirmation, written objections to the proposed improvements have been filed by the owners of the property which will be required to bear more that 50 percent of amount of the special assessment.
7. If the Village Council approves the establishment of the special assessment district and the making of the improvements, a special assessment will be levied against properties that benefit from the improvements. The Tax Tribunal Act, Act No. 186, Public Acts of Michigan, 1973 as amended, provides that an appearance and protest of the special assessment must be made at the hearing described above in order to appeal the amount of the special assessment to the Michigan Tax Tribunal. An owner of or party in interest in property to be assessed, or his or her agent, may appear in person to protest the special assessment, by letter filed with the Village clerk at or prior to the time of the hearing, in which case appearance in person is not required.

for the Residents of the
Goodrich-Ortonville Area
The Genesee-Lapeer-Shiawassee Region V Planning and Development Commission (GLS Region V) will be holding a Small Urban Program meeting. You are invited to participate in this meeting to be held on Wednesday, April 9, 2014 at 2:00 p.m. at the Village of Goodrich Offices, 7338 S. State Road, Goodrich, MI 48438.
Cities, villages, transit agencies, and road commissions located within or serving urbanized areas, as defined by U.S. Census with a population of 5,000 to 50,000, are eligible to receive federal Surface Transportation Program (STP) funds from the Small Urban Program. During a call for projects, the Michigan Department of Transportation (MDOT) requests that eligible areas submit road and transit capital projects for funding consideration.
The purpose of the meeting is to discuss and prioritize proposed projects to submit to MDOT for improvements within the Small Urban Area boundary that includes: the Village of Goodrich and a small area around the Village of Goodrich under the jurisdiction of the Genesee County Road Commission; and the Village of Ortonville and a small area around the Village of Ortonville under the jurisdiction of the Road Commission for Oakland County.

NOTICE OF ORDINANCE ADOPTION
VILLAGE OF GOODRICH
ORDINANCE NO. 142
PUBLIC NOTICE is hereby given that Ordinance No.142 was adopted by the Council of the Village of Goodrich on April 13, 2009. The Ordinance will take effect on April 24, 2008. A summary of the Ordinance is set forth below.
Ordinance Summary
The Ordinance provides the necessary authority and regulatory mechanisms to accomplish the following primary purposes, policies and objectives:
Ordinance No.142 repeals in its entirety the following existing Ordinance(s) of the Village: [list any affected city, township, village ordinances here, including title, ordinance number, etc.] ; and adopts a new ‘Genesee County Sewer Use Ordinance for the Village of Goodrich? (hereinafter referred to as the ‘Ordinance?).
The Ordinance establishes uniform requirements for discharges by users located within the Village of Goodrich to the Genesee County Publicly Owned Treatment Works, and to enable the Village and the County Agency to comply with applicable state and federal laws as required by the Federal Water Pollution Control Act (also known as the ‘Clean Water Act?), as amended, 33 USC 1251, et seq.; the General Pretreatment Regulations (40 CFR part 403); Part 31 of Act 451 of the Public Acts of Michigan of 1994, MCL ?? 324.3101 et seq., as amended (‘Water Resources Protection?); and the rules, Michigan Administrative Code, R 323.2301 et seq., as amended, promulgated pursuant to Sections 3103, 3106 and 3109 of Part 31 of Act 451 of the Public Acts of Michigan of 1994, as amended.
The Ordinance prohibits the discharge of pollutants from within the Village of Goodrich into the Genesee County POTW that do not meet applicable pretreatment standards and requirements; that would interfere with the operation of the POTW; that would pass through the POTW into the receiving waters or the atmosphere, the environment, or otherwise be incompatible with the POTW; that would inhibit or disrupt the POTW’s processing, use, or disposal of sludge; that would cause health or safety problems for POTW workers; or that would result in a violation of the POTW’s NPDES permit or of other applicable laws and regulations.
The Ordinance is intended to improve the opportunity to recycle and reclaim wastewaters and sludges from the Genesee County POTW, as required by law.
The Ordinance regulates the discharge of wastewater and/or pollutants to the POTW and provides the authority to enforce the requirements of the Ordinance through the issuance of permits and through other means as provided by the Ordinance.
The Ordinance authorizes and requires all inspection, monitoring, reporting and enforcement activities as necessary to insure compliance with applicable pretreatment standards and requirements and other applicable laws and regulations.
The Ordinance provides for the equitable distribution and recovery of costs from users of the Genesee County POTW sufficient to administer regulatory activities and to meet the costs of the operation, maintenance, improvement and replacement of the POTW.
The Ordinance applies to any person that discharges to the Genesee County POTW from within the Village. The Ordinance also applies to any person owning, using, constructing or maintaining any private system or facility intended or used for the disposal of sewage or wastewater within the Village.
The Ordinance designates, empowers and authorizes the Genesee County POTW to act as the agent and representative of the Village for purposes of administering and enforcing the Ordinance within the Village. This includes, but is not limited to, the power and authority of the POTW, as deemed necessary by the POTW, to immediately and independently investigate, enforce, and prosecute (administratively or judicially, and civilly or criminally) any violation of the Ordinance or of any notice, order, permit, decision or determination promulgated, issued or made by the POTW under the Ordinance, and to otherwise implement the requirements of the Ordinance.
The Ordinance makes it unlawful for any person to discharge any wastewater or pollutant to the POTW or to any storm sewer or natural outlet within the Village or in any area under the jurisdiction of the Village of Goodrich, except in accordance with the provisions of the Ordinance and other applicable laws and regulations. If any user discharges or proposes to discharge wastewaters or pollutants that are prohibited or limited by the Ordinance, the POTW may take any action as provided by the Ordinance or other applicable laws or regulations to assure and require compliance with the provisions of the Ordinance.
The publication of this notice and summary of the Ordinance is intended to meet the requirements for publication as authorized under the provisions of [use this citation for an incorporated village: Section 78.23 of the Michigan Codified Laws] [use this citation for a general law village: Section 66.4 of the Michigan Codified Laws]. CONSUMERS ENERGY COMPANY ELECTRIC FRANCHISE ORDINANCE
AN ORDINANCE, granting to CONSUMERS ENERGY COMPANY, its successors and assigns, the right, power and authority to construct, maintain and commercially use electric lines consisting of towers, masts, poles, crossarms, guys, braces, feeders, transmission and distribution wires, transformers and other electrical appliances on, under, along and across the highways, streets, alleys, bridges, waterways, and other public places, and to do a local electric business in the
VILLAGE OF GOODRICH, GENESEE COUNTY, MICHIGAN, for a period of thirty years.
THE VILLAGE OF GOODRICH ORDAINS:
SECTION 1. GRANT, TERM. The VILLAGE OF GOODRICH, GENESEE COUNTY, MICHIGAN, hereby grants the right, power and authority to the Consumers Energy Company, a Michigan corporation, its successors and assigns, hereinafter called the ‘Grantee,? to construct, maintain and commercially use electric lines consisting of towers, masts, poles, crossarms, guys, braces, feeders, transmission and distribution wires, transformers and other electrical appliances for the purpose of transmitting, transforming and distributing electricity on, under, along and across the highways, streets, alleys, bridges, waterways, and other public places, and to do a local electric business in the VILLAGE OF GOODRICH, GENESEE COUNTY, MICHIGAN, for a period of thirty years.
SECTION 2. CONSIDERATION. In consideration of the rights, power and authority hereby granted, said Grantee shall faithfully perform all things required by the terms hereof.
SECTION 3. CONDITIONS. No highway, street, alley, bridge, waterway or other public place used by said Grantee shall be obstructed longer than necessary during the work of construction or repair, and shall be restored to the same order and condition as when said work was commenced. All of Grantee’s structures and equipment shall be so placed on either side of the highways as not to unnecessarily interfere with the use thereof for highway purposes. All of Grantee’s wires carrying electricity shall be securely fastened so as not to endanger or injure persons or property in said highways. The Grantee shall have the right to trim trees if necessary in the conducting of such business, subject, however, to the supervision of the highway authorities.
SECTION 4. HOLD HARMLESS. Said Grantee shall at all times keep and save the Village free and harmless from all loss, costs and expense to which it may be subject by reason of the negligent construction and maintenance of the structures and equipment hereby authorized. In case any action is commenced against the Village on account of the permission herein given, said Grantee shall, upon notice, defend the Village and save it free and harmless from all loss, cost and damage arising out of such negligent construction and maintenance.
SECTION 5. EXTENSIONS. Said Grantee shall construct and extend its electric distribution system within said Village, and shall furnish electric service to applicants residing therein in accordance with applicable laws, rules and regulations.
SECTION 6. FRANCHISE NOT EXCLUSIVE. The rights, power and authority herein granted, are not exclusive.
SECTION 7. RATES. Said Grantee shall be entitled to charge the inhabitants of said Village for electricity furnished therein, the rates as approved by the Michigan Public Service Commission, to which Commission or its successors authority and jurisdiction to fix and regulate electric rates and rules regulating such service in said Village, are hereby granted for the term of this franchise. Such rates and rules shall be subject to review and change at any time upon petition therefor being made by either said Village, acting by its Village Council, or by said Grantee.
SECTION 8. REVOCATION. The franchise granted by this ordinance is subject to revocation upon sixty (60) days written notice by the party desiring such revocation.
SECTION 9. MICHIGAN PUBLIC SERVICE COMMISSION, JURISDICTION. Said Grantee shall, as to all other conditions and elements of service not herein fixed, be and remain subject to the reasonable rules and regulations of the Michigan Public Service Commission or its successors, applicable to electric service in said Village.
SECTION 10.REPEALER. This ordinance, when accepted and published as herein provided, shall repeal and supersede the provisions of an electric ordinance adopted by the Village on February 13, 1984 entitled:
AN ORDINANCE, granting to CONSUMERS POWER COMPANY, its successors and assigns, the right, power and authority to construct, maintain and commercially use electric lines consisting of towers, masts, poles, crossarms, guys, braces, feeders, transmission and distribution wires, transformers and other electrical appliances on, under, along and across the highways, streets, alleys, bridges and other public places, and to do a local electric business in the VILLAGE OF GOODRICH, GENESEE COUNTY, MICHIGAN.
and amendments, if any, to such ordinance whereby an electric franchise was granted to Consumers Energy Company.
SECTION 11. EFFECTIVE DATE. This ordinance shall take effect March 20, 2014, after the date of publication thereof; provided, however, it shall cease and be of no effect after thirty days from its adoption unless within said period the Grantee shall accept the same in writing filed with the Village Clerk. Upon acceptance and publication hereof, this ordinance shall constitute a contract between said Village and said Grantee.
We certify that the foregoing Franchise Ordinance was duly enacted by the Village Council of the VILLAGE OF GOODRICH, GENESEE COUNTY, MICHIGAN, on the 10th day of March, 2014.

Report Is Available For Review
The Report Authorized By The Genesee County Drain Commission Was Completed By Fleis & Vandenbrink Engineering And Submitted To The Village Of Goodrich For Review. The Report Describes The Current Logistics Pertaining To The Wheelock & Watkins Drain And Recommends Two Alternative Plans That Addresses The Flooding That Occurred In The Village. Both Plans Would Replace The Current Drain (Which The Report Deems Under Sized) With Larger Sized Drain Pipes And Would Cost Upward Of $600,000. 00 To $700,000.00 The Drain Commission Has The Final Authority To Select And Approve The Construction Of A New Drain And The Method Of Financing. ORDINANCE NO. 141 AMENDING CHAPTER 10 SECTIONS 33 AND 37 OF
THE VILLAGE OF GOODRICH
CODE OF ORDINANCES
The Village of Goodrich hereby ordains that Sections 10-33 AND 10-37 shall be amended to read as follows:
Section 10-31. Title
This chapter shall be known and may be referred to as ‘The Weed Ordinance of the Village of Goodrich?.
Section 10-32. Enforcement; commissioner of noxious weeds
The village administrator or the duly authorized designate of the village administrator shall be charged with the responsibility of enforcement of this chapter and shall be the commissioner of noxious weeds as provided in Public Act 359 of 1941.
Section 10-33. Notice to abate
When in the opinion of the village administrator, or the duly authorized designate of the village administrator, a public hazard or nuisance which is dangerous to the health, safety or welfare is created by the uncontrolled growing of noxious weeds, brush or other vegetation on private property, a notice shall be given to the person or persons whose name or names appear on the tax rolls of the village in connection with the premises in question in one of the following ways, requiring the hazard or nuisance to be abated at a time set by the village administrator or the duly authorized designate of the village administrator:
(1) A letter in writing addressed to the name and address appearing on the tax rolls mailed postage prepaid by certified mail, return receipt demanded;
(2) A notice in a newspaper circulated by the village setting forth the description of the property by location or legal description and setting forth the name or names appearing on the tax rolls in connection with the premises;
(3) By personal service;
(4) A notice in a newspaper of general circulation, during the month of MARCH, that weeds not cut between MAY first (1ST) and OCTOBER first (1ST) of that year may be cut by the village. The notice shall state that the owner may be charged with all costs as provided in Section 10-36 and shall describe methods of treating and eradicating the noxious weeds. If this notice is given, the village may cut weeds as many times as is necessary and charge all costs to the property owner.
Section 10-34 Failure to give notice
Failure to give the notice as required in Section 10-33 shall not, however, constitute a defense to any action to enforce payment of any penalty provided for or debt created under the provisions of this chapter.
Section 10-35 Abatement by village ? authorized
In the event the nuisance shall not have been abated after notice as provided herein, it shall be the duty of the village administrator or the duly authorized designate of the village administrator to abate the nuisance, either utilizing village crews or private contractors. This chapter and Public Act 359 of 1941 of the State of Michigan, as amended, shall constitute the authority to enter onto private property to carry out the provisions hereof.
Section 10-36 Same-Charges
The charge to be assessed against the property shall be based upon the actual cost of doing the work, plus an administration fee. The amount of the administration fee may be a flat fee or a percentage of the actual cost of doing the work as determined by resolution of the Village Council. The charge shall be paid by the property owner, but if it is not paid within thirty (30) days after invoice, the charge shall be placed on the tax roll for the property.
Section 10-37 Definition
(1) For the purposes of this chapter, ‘noxious weeds? as defined in Act 351 of 1941 is hereby adopted. Such noxious weeds shall include but not be necessarily restricted to Canada thistle, (Circium arvense), dodders (any species of Cusucta), mustards (charlock, black mustard and Indian mustard, species of Brassica or Siapsis), wild carrot (Daucus carota), bindweed (Convolulus arvensis), perennial sowthistle (Sonchus arvensis), hoary alyssum (Berterea incana), ragweed (Ambrosia clatior 1.), poison ivy (Rhus toxicondendron), poison sumac (Toxicannendron vernix) and any other plant which in the opinion of the village council after due consideration is so declared by resolution.
(2) In addition, the term ‘noxious weeds? shall include all grasses, brush, and vegetation (other than properly landscaped trees and shrubs or cultivated flowers or gardens) in excess of eight (8) inches in height.
Section 10-38 Penalties for violation of chapter.
(1) Violation of the provisions of this chapter or failure to comply with any of its requirements shall constitute a misdemeanor.
(2) Each day such violation continues shall be considered a separate offense.
(3) Nothing contained in this section shall prevent the village from taking such other lawful action as is necessary to prevent or remedy any violation.

ORDINANCE NO. 141 AMENDING CHAPTER 10 SECTIONS 33 AND 37 OF
THE VILLAGE OF GOODRICH
CODE OF ORDINANCES
The Village of Goodrich hereby ordains that Sections 10-33 AND 10-37 shall be amended to read as follows:
Section 10-31. Title
This chapter shall be known and may be referred to as ‘The Weed Ordinance of the Village of Goodrich?.
Section 10-32. Enforcement; commissioner of noxious weeds
The village administrator or the duly authorized designate of the village administrator shall be charged with the responsibility of enforcement of this chapter and shall be the commissioner of noxious weeds as provided in Public Act 359 of 1941.
Section 10-33. Notice to abate
When in the opinion of the village administrator, or the duly authorized designate of the village administrator, a public hazard or nuisance which is dangerous to the health, safety or welfare is created by the uncontrolled growing of noxious weeds, brush or other vegetation on private property, a notice shall be given to the person or persons whose name or names appear on the tax rolls of the village in connection with the premises in question in one of the following ways, requiring the hazard or nuisance to be abated at a time set by the village administrator or the duly authorized designate of the village administrator:
(1) A letter in writing addressed to the name and address appearing on the tax rolls mailed postage prepaid by certified mail, return receipt demanded;
(2) A notice in a newspaper circulated by the village setting forth the description of the property by location or legal description and setting forth the name or names appearing on the tax rolls in connection with the premises;
(3) By personal service;
(4) A notice in a newspaper of general circulation, during the month of MARCH, that weeds not cut between MAY first (1ST) and OCTOBER first (1st) of that year may be cut by the village. The notice shall state that the owner may be charged with all costs as provided in Section 10-36 and shall describe methods of treating and eradicating the noxious weeds. If this notice is given, the village may cut weeds as many times as is necessary and charge all costs to the property owner.
Section 10-34 Failure to give notice
Failure to give the notice as required in Section 10-33 shall not, however, constitute a defense to any action to enforce payment of any penalty provided for or debt created under the provisions of this chapter.
Section 10-35 Abatement by village ? authorized
In the event the nuisance shall not have been abated after notice as provided herein, it shall be the duty of the village administrator or the duly authorized designate of the village administrator to abate the nuisance, either utilizing village crews or private contractors. This chapter and Public Act 359 of 1941 of the State of Michigan, as amended, shall constitute the authority to enter onto private property to carry out the provisions hereof.
Section 10-36 Same-Charges
The charge to be assessed against the property shall be based upon the actual cost of doing the work, plus an administration fee. The amount of the administration fee may be a flat fee or a percentage of the actual cost of doing the work as determined by resolution of the Village Council. The charge shall be paid by the property owner, but if it is not paid within thirty (30) days after invoice, the charge shall be placed on the tax roll for the property.
Section 10-37 Definition
(1) For the purposes of this chapter, ‘noxious weeds? as defined in Act 351 of 1941 is hereby adopted. Such noxious weeds shall include but not be necessarily restricted to Canada thistle, (Circium arvense), dodders (any species of Cusucta), mustards (charlock, black mustard and Indian mustard, species of Brassica or Siapsis), wild carrot (Daucus carota), bindweed (Convolulus arvensis), perennial sowthistle (Sonchus arvensis), hoary alyssum (Berterea incana), ragweed (Ambrosia clatior 1.), poison ivy (Rhus toxicondendron), poison sumac (Toxicannendron vernix) and any other plant which in the opinion of the village council after due consideration is so declared by resolution.
(2) In addition, the term ‘noxious weeds? shall include all grasses, brush, and vegetation (other than properly landscaped trees and shrubs or cultivated flowers or gardens) in excess of eight (8) inches in height.
Section 10-38 Penalties for violation of chapter.
(1) Violation of the provisions of this chapter or failure to comply with any of its requirements shall constitute a misdemeanor.
(2) Each day such violation continues shall be considered a separate offense.
(3) Nothing contained in this section shall prevent the village from taking such other lawful action as is necessary to prevent or remedy any violation.

4. The special assessments on said special assessment roll for the District against each parcel of land thereon shall be due on July 1, 2013 and July 1 each year of the assessment.
5. The Village Council will meet in the Village Office, Lower Level, Community Room, 7338 S State Road, Goodrich, Michigan, at 7:00 PM, Eastern Daylight Time, on Monday, June 10, 2013, in order to hold a public hearing for the purpose of correcting and reviewing the special assessment roll. At such hearing, the Council shall review said roll and hear and consider any objections or suggestions which may be submitted by any interested person with respect to: (1) the roll; (2) the proposed improvement; (3) the assessing of the District therefor; (4) the portion of the cost of the improvements to be paid by special assessment; (5) the method of determining the benefits upon the property in the District.
6. The Village Council may then, or at a later date confirm the roll as reported or corrected. However, the original special assessment roll shall not be confirmed except by the affirmative vote of four members of the Council, if prior to such confirmation, written objections to the proposed improvements have been filed by the owners of the property which will be required to bear more than 50 percent of amount of the special assessment.
7. If the Village Council approves the establishment of the special assessment district and the making of the improvements, a special assessment will be levied against properties that benefit from the improvements. The Tax Tribunal Act, Act No. 186, Public Acts of Michigan, 1973 as amended, provides that an appearance and protest of the special assessment must be made at the hearing described above in order to appeal the amount of the special assessment to the Michigan Tax Tribunal. An owner of or party in interest in property to be assessed, or his or her agent, may appear in person to protest the special assessment, by letter filed with the Village clerk at or prior to the time of the hearing, in which case appearance in person in not required.

Please take notice that the Goodrich Village Council, at their regular meeting held on the 13th day of February, 2012, adopted an amendment to Chapter 2, Administration, of the Code of Ordinances. Specifically, Chapter 2, ‘Administration,? of the Village of Goodrich Code of Ordinances, Article IV, ‘Boards and Commissions,? Division 2, ‘Planning Commission? has been revised in order to conform to the Michigan Planning Enabling Act, M.C.L. 125.3801 et. Seq. (P.A. 33 of 2008), as amended. Pursuant to the Michigan Planning Enabling Act, (P.A. 33), notice is hereby given that the Village of Goodrich Planning Commission will hold a public hearing on June 25, 2008 to present the draft master plan. Residents will have the opportunity to provide comments on the draft Master Plan and their comments will be used to help finalize the master plan for Goodrich.
The master plan serves as the Village’s guide for decisions on future development in Goodrich, including development issues related to:

? Future land uses
? Development standards
? Transportation and circulation
? Community facilities and services

CUTTING OF NOXIOUS WEEDS TO OWNERS OF LAND SITUATED IN THE VILLAGE OF GOODRICH, GENESEE COUNTY, STATE OF MICHIGAN:
NOTICE is hereby given that all noxious weeds and/or grass found growing to a height greater than six (6″) inches in height may be cut by the Village and the owner of the property according to the Village tax rolls may be charged with the costs including the actual cost of doing the work and an administration fee as determined by Resolution of the Goodrich Village council.
The Village will cut the weeds with a lawnmower or other appropriate device.
This Notice authorizes the Village to cut the weeds as many times as is necessary and to charge all costs to the property owner.
The property owner of any land or premises will be determined by a search of the tax records in the Village. (Ordinance No. _140, Village Code of Ordinances Sections 10-31 through 10-38.

Notice of intent to issue bonds by the village of
Goodrich, Michigan
Notice is hereby given, that the Village of Goodrich, Michigan, intends to issue limited tax general obligation bonds in one or more series in the principal amount of not to exceed $400,000 for the purpose of defraying all or part of the cost of improvements to the Dutch Road Bridge over Kearsley Creek and Erie Street in the Village of Goodrich.
The bonds will bear interest from their date at a rate or rates not exceeding 8% per annum.
The bonds will be issued under and pursuant to the provisions of Act No. 34, Public Acts of Michigan, 2001, as amended. It is anticipated that a portion of the principal of and interest on the bonds will be paid from moneys to be derived from State of Michigan collected taxes returned to the Village of Goodrich for highway purposes pursuant to law. In addition, the full faith and credit of the Village of Goodrich will be pledged to pay the principal of and interest on the bonds as the same shall become due. The Village of Goodrich will be obligated, as a first budget obligation, to advance moneys from its general funds or to levy ad valorem taxes on all taxable property within its corporate boundaries to pay the principal of and interest on the bonds as the same shall become due to the extent that other moneys are not available for such purpose; provided, however, that the amount of taxes necessary to pay the principal of and interest on the bonds, together with the taxes levied for the same year, shall not exceed the limit authorized by law.
RIGHT TO PETITION FOR REFERENDUM
This notice is given by order of the Village Council of the Village of Goodrich, to and for the benefit of the electors of the Village of Goodrich in order to inform them of their right to petition for a referendum upon the question of the issuance of the aforesaid bonds. The bonds will be issued, without submitting such a question to a vote of the electors, unless within 45 days after the date of publication of this notice a petition requesting a referendum upon such question, signed by not less than 10% or 15,000 of the registered electors residing within the Village of Goodrich, whichever is the lesser, shall have been filed with the undersigned Village Clerk. In the event that such a petition is filed, the bonds will not be issued unless and until the issuance thereof shall have been approved by the vote of a majority of the electors of the Village of Goodrich qualified to vote and voting thereon at a general or special election.

ORDINANCE NO. 140 AMENDING SECTIONS 10-31 THROUGH 10-36 OF THE VILLAGE OF GOODRICH
CODE OF ORDINANCES
The Village of Goodrich hereby ordains that Sections 10-31 through 10-36 shall be amended to read as follows:
Section 10-31. Title
This chapter shall be known and may be referred to as “The Weed Ordinance of the Village of Goodrich”.
Section 10-32. Enforcement; commissioner of noxious weeds
The village administrator or the duly authorized designate of the village administrator shall be charged with the responsibility of enforcement of this chapter and shall be the commissioner of noxious weeds as provided in Public Act 359 of 1941.
Section 10-33. Notice to abate
When in the opinion of the village administrator, or the duly authorized designate of the village administrator, a public hazard or nuisance which is dangerous to the health, safety or welfare is created by the uncontrolled growing of noxious weeds, brush or other vegetation on private property, a notice shall be given to the person or persons whose name or names appear on the tax rolls of the village in connection with the premises in question in one of the following ways, requiring the hazard or nuisance to be abated at a time set by the village administrator or the duly authorized designate of the village administrator:
(1) A letter in writing addressed to the name and address appearing on the tax rolls mailed postage prepaid by certified mail, return receipt demanded;
(2) A notice in a newspaper circulated by the village setting forth the description of the property by location or legal description and setting forth the name or names appearing on the tax rolls in connection with the premises;
(3) By personal service;
(4) A notice in a newspaper of general circulation, during the month of April, that weeds not cut by May first of that year may be cut by the village. The notice shall state that the owner may be charged with all costs as provided in Section 10-36 and shall describe methods of treating and eradicating the noxious weeds. If this notice is given, the village may cut weeds as many times as is necessary and charge all costs to the property owner.
Section 10-34 Failure to give notice
Failure to give the notice as required in Section 10-33 shall not, however, constitute a defense to any action to enforce payment of any penalty provided for or debt created under the provisions of this chapter.
Section 10-35 Abatement by village – authorized
In the event the nuisance shall not have been abated after notice as provided herein, it shall be the duty of the village administrator or the duly authorized designate of the village administrator to abate the nuisance, either utilizing village crews or private contractors. This chapter and Public Act 359 of 1941 of the State of Michigan, as amended, shall constitute the authority to enter onto private property to carry out the provisions hereof.
Section 10-36 Same-Charges
The charge to be assessed against the property shall be based upon the actual cost of doing the work, plus an administration fee. The amount of the administration fee may be a flat fee or a percentage of the actual cost of doing the work as determined by resolution of the Village Council. The charge shall be paid by the property owner, but if it is not paid within thirty (30) days after invoice, the charge shall be placed on the tax roll for the property.
Section 10-37Definition
(1) For the purposes of this chapter, “noxious weeds” as defined in Act 351 of 1941 is hereby adopted. Such noxious weeds shall include but not be necessarily restricted to Canada thistle, (Circium arvense), dodders (any species of Cusucta), mustards (charlock, black mustard and Indian mustard, species of Brassica or Siapsis), wild carrot (Daucus carota), bindweed (Convolulus arvensis), perennial sowthistle (Sonchus arvensis), hoary alyssum (Berterea incana), ragweed (Ambrosia clatior 1.), poison ivy (Rhus toxicondendron), poison sumac (Toxicannendron vernix) and any other plant which in the opinion of the village council after due consideration is so declared by resolution.
(2) In addition, the term “noxious weeds” shall include all grasses, brush, and vegetation (other than properly landscaped trees and shrubs or cultivated flowers or gardens) in excess of six (6) inches in height.
Section 10-38 Penalties for violation of chapter.
(1) Violation of the provisions of this chapter or failure to comply with any of its requirements shall constitute a misdemeanor.
(2) Each day such violation continues shall be considered a separate offense.
(3) Nothing contained in this section shall prevent the village from taking such other lawful action as is necessary to prevent or remedy any violation.
