James Tuohy, 61, of Metamora has been charged with breaking in and illegal entering one of his own motel units..
Tuohy, the former owner of the Lakeshore Motel on South Broadway, was arraigned and released on personal bond at Rochester’s 3rd/2nd District Court on Oct. 14.
The incident took place on July 29. A complaint filed by a couple alleged Tuohy was outside their window listening to them while they were having an intimate encounter.
According to the two female victims, they heard him calling and hollering to two friends while he was listening. They then heard him using a key and unlocking their room. Tuohy and his two friends allegedly entered the bedroom of the couple.
The couple immediately called the police.
According to Lake Police Chief Jerry Narsh, all the people involved in the incident were questioned and a warrant was issued for Touhy.
His two friends weren’t charged, Narsh said, because there was some perception on the part of the two men of Touhy’s ownership.
“Both victims were extremely upset. Obviously their privacy was violated,” he added. “Even as the owner of the motel, Tuohy has no right to enter a tenant’s apartment without lawful permission.”
Tuohy has a previous criminal history. If found guilty of the misdemeanor charges, he could face a fine/jail time.
