Cass Street — public or private?

Homeowner Donald Ruff recently asked village council members if they have any plans to pave his street, Cass. The council told him they needed to find out if the street was public or private.
Lake Orion Village Manager JoAnn Van Tassel at the Aug. 22 council meeting indicated Cass should be considered a public road.
She found out the street was platted as a public road in 1884.
Then in 1979, the village council took action to vacate a portion of Cass Street so Atwater Park could be more fully developed.
The village created a road along the north side of Atwater Park and labeled it Cass Street.
‘Even though the roadway is owned by the village, no record can be found as to the village declaring that road a public road,? Van Tassel.
Based on her investigation, Van Tassel recommended Cass Street be declared a public road. The council agreed.
According to councilman Douglas Dendel, paving Cass Street was part of the village’s 1998 paving program.
LO Clerk Arlene Nichols told him some projects had to be taken out of the program because costs were higher than expected.
Dendel said Cass Street is located in the Downtown Development A0uthority District and it should be responsible for paving the street.
The village’s engineers, Hubbell, Roth & Clark, will be asked to prepare a cost estimate on the paving project.
